Who we are
These Terms form a binding agreement between Faction Community, LLC, doing business as DecaTrend, and the person or entity using the Service. If you use the Service for a company, agency, client, team, or other organization, you represent that you have authority to bind that organization.
DecaTrend is a web SaaS platform that turns uploaded creator video into short-form clips, montage exports, captions, virality scores, trend recommendations, direct social-platform posting, and portable OpenCut project files.
Eligibility and accounts
- You must be at least 13 years old to create a standard account. A higher minimum age may apply in some countries or regions.
- If you are under 18, you may use the Service only with permission from a parent or legal guardian, and DecaTrend may restrict features through Teen Mode.
- DecaTrend does not support standard accounts for children under 13 at launch. Under-13 use requires a separate parental-consent program that is not currently offered unless expressly enabled in writing.
- You are responsible for keeping your login credentials, sessions, API keys, connected platform accounts, and workspace access secure.
- You must provide accurate account and billing information and keep it current.
- We may suspend or terminate accounts that create security, legal, payment, abuse, or platform-policy risk.
Teen Mode and age assurance
DecaTrend may ask for date of birth, region, or other age-assurance information to determine which features are available. We aim to use the least intrusive age-assurance method that is appropriate for the risk.
Teen accounts may have restricted access to public sharing, monetization, discoverability, community features, direct platform posting, and higher-risk voice, face, avatar, or synthetic-media tools unless additional verification or adult approval is completed.
Subscriptions, credits, and billing
- Paid plans are subscription based and are processed by Stripe. We do not store full payment card numbers.
- Plans include monthly credits, storage-retention periods, export limits, queue priority, and feature access based on tier.
- Credits are consumed by compute-heavy actions such as clip generation, montage rendering, and export rendering.
- Subscriptions renew automatically unless cancelled before renewal through the billing portal or another supported cancellation path.
- Plan limits, prices, included credits, and feature access may change prospectively with notice where required by law.
Your content
You keep ownership of content you upload and outputs generated for you, subject to any rights held by third parties and any licensed material included in your content.
You grant DecaTrend a limited license to host, store, transmit, process, transform, caption, score, render, display, and deliver your content and outputs solely to provide, secure, support, and improve the Service as described in our Privacy Policy.
- You must have all rights and permissions needed for uploaded video, audio, music, images, likenesses, voices, trademarks, captions, prompts, and platform posts.
- You are responsible for reviewing outputs before publishing or relying on them.
- You are responsible for complying with the terms and policies of TikTok, YouTube, Instagram, OpenCut, and any other connected third-party service.
AI-assisted outputs and scoring
AI-generated edits, scripts, captions, recommendations, scores, and other outputs are provided for creative assistance only. They may be inaccurate, incomplete, non-unique, or unsuitable for your intended use. They are not legal, medical, financial, or other professional advice.
Virality scores, trend intelligence, posting suggestions, and performance estimates are heuristic predictions. They do not guarantee views, revenue, conversions, compliance, monetization, or platform approval.
No customer-content training by default
Based on the current codebase and product design, DecaTrend does not use uploaded customer media to train third-party generative AI models or build a customer-content training dataset by default.
If DecaTrend later offers an optional model-improvement or data-sharing program, it should be opt-in, separately disclosed, and controllable by the user or workspace administrator.
Platform posting and connected accounts
- If you connect a platform account, DecaTrend may store encrypted access and refresh tokens, platform account identifiers, expiration timestamps, and related metadata needed to post on your behalf.
- You authorize DecaTrend to use connected platform credentials only for actions you request, such as connecting, refreshing, posting, or disconnecting.
- Direct posting may fail or be delayed because of platform APIs, review systems, rate limits, or policy restrictions outside DecaTrend control.
API access
- API access is available only on eligible plans.
- API keys are shown once at creation; DecaTrend stores only a hash, key name, creation time, last-used time, and revocation state.
- You may not share, resell, abuse, scrape, overload, reverse engineer, or circumvent API limits, credit gates, or tier restrictions.
Acceptable use
You must follow the Acceptable Use Policy, which is incorporated into these Terms. We may remove content, disable outputs, revoke API keys, disconnect platform integrations, suspend jobs, or terminate access when we reasonably believe the Service is being misused.
Child safety and reportable material
You may not upload, generate, edit, request, store, post, or distribute child sexual abuse material, sexualized content involving minors, grooming content, exploitative content, or content that endangers children.
If DecaTrend obtains actual knowledge of or apparent facts involving reportable child sexual exploitation material, DecaTrend may preserve relevant files and metadata, report to the appropriate authorities or NCMEC CyberTipline where required or appropriate, suspend accounts, and cooperate with lawful requests.
Service availability and retention
- The Service depends on Supabase, Stripe, DigitalOcean/S3-compatible storage, Inngest, worker infrastructure, email/SMS/push providers, and third-party platform APIs.
- Uploaded and generated media is retained according to your plan: Starter 7 days, Creator 30 days, Pro 90 days, and Studio 365 days unless changed in the product or required by law.
- Expired job files are deleted from storage and the job is marked expired. Metadata may remain as described in the Privacy Policy unless you delete your account or exercise applicable rights.
Disclaimers and limits of liability
The Service is provided as is and as available. To the maximum extent permitted by law, DecaTrend disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
To the maximum extent permitted by law, DecaTrend will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost content, platform takedowns, or loss of goodwill.
DecaTrend total aggregate liability for all claims will not exceed the greater of the amounts you paid to DecaTrend in the 12 months before the event giving rise to the claim or [placeholder-liability-cap].
Governing law and disputes
These Terms are governed by the laws of North Carolina, USA, without regard to conflict-of-law rules. Venue and dispute process: state and federal courts located in North Carolina, USA, unless an enforceable arbitration clause or mandatory consumer-law rule says otherwise. If arbitration, class waiver, or consumer-law carveouts are used, they should be reviewed by counsel before publication.
